Getting Your Children They Support They Need

Special Educational Needs and Disabilities (SEND)

Special educational needs, often referred to as ‘SEN’ or ‘SEND’ (Special educational needs and disabilities), is a term used to describe learning difficulties or disabilities that make it harder for a child to learn compared to children of the same age.

All children may experience challenges with their learning at some point and for most children, these difficulties overcome with support from teachers and home. However, children with SEND are likely to need extra or different help to be able to learn. Some children may have SEND because of a medical condition or disability, other children may have SEND without a diagnosis or disability. Children are not considered to have SEND just because their first language is not English. Although some children for whom is English is a second language may also have SEND.

Special educational needs and disabilities (SEND) can affect a child or young person’s ability to learn. They can affect their:

  • Behaviour or ability to socialise, for example they struggle to make friends or understand social ques
  • Reading and writing
  • Ability to understand things, you may notice they struggle to take to many actions and become overwhelmed
  • Concentration levels
  • Physical ability

Family Support

In the same way that fathers have rights and can go to court to put in place regular and consistent contact to see their children, mothers can do the same if the father and children want to see each other.

As a life coach, we can help mothers to apply to the courts for a child contact order which is a legal document that holds legal penalties if not adhered to.

Before applying to court for a child contact order, usually the courts expect mediation to be attempted first (although this is not necessary if there has been evidenced of domestic violence), mediation can be a good way to sort out issues with contact in the first instance but If your child’s other parent refuses mediation or does not attend the meeting, the mediator will give you a C100 form to attach to your court application. This is a necessary step before you can go to court for the child contact arrangement unless you have suffered domestic violence.

If the child contact arrangement is broken without reasonable justification either parent can apply for a contact arrangement enforcement order.

An enforcement order is reviewed and made by a court. The family court may issue an Enforcement Order as a penalty for a parent/ someone with parental responsibility who has breached a Child Arrangement Order. They will always check if the claim of a breach of the order is true or not, and if it is reasonable. If one of the parents are financially impacted due to the contact arrangement being broken, that parent can reclaim those costs in court. Penalties can also be to the parent that have continuously broken the child contact arrangement without good reason by way of a fine, community service and as a worst-case scenario, prison.

Diverse Consultancy can help families to reach an agreement in court without the aid of a solicitor, we also support court applications for a prohibited steps order (PSO) to prevent another parent with parent rights from changing your child’s name, moving to another part of the country, taking the child out of the country, change their school or give them medicine or allow for another service to medicate them.
